Facts:
Cynthia V. Nittscher v. Dr. Werner Karl Johann Nittscher (Deceased), Atty. Rogelio P. Nogales and the Regional Trial Court of Makati (Branch 59), G.R. Nittscher challenged proceedings in the probate of the holographic will of her husband, Dr. Werner Karl Johann Nittscher. On January 31, 1990, Dr. Nittscher filed with the Regional Trial Court (RTC) of Makati City a petition for the probate of his holographic will and for the issuance of letters testamentary in favor of Atty. Rogelio P. Nogales.
On September 19, 1991, after hearing and with notice to compulsory heirs, the RTC issued an order allowing the holographic will. Dr. Nittscher died on September 26, 1994, and Atty. Nogales thereafter filed a petition for letters testamentary. Petitioner moved to dismiss that petition; on September 29, 1995 the RTC denied the motion to dismiss and granted the petition for issuance of letters testamentary to Atty. Nogales, ordering issuance without bond. Petitioner’s motion for reconsideration was denied, and letters testamentary were issued and Atty. Nogales was sworn in on May 9, 1996.
Petitioner appealed to the Court of Appeals (CA), asserting among other grounds that (a) the petition for letters testamentary lacked a certification against forum-shopping in violation of Revised Circular No. 28-91 and Administrative Circular No. 04-94; (b) the RTC lacked jurisdiction because Dr. Nittscher allegedly was not a resident of the Philippines and left no Philippine real property; and (c) she was denied due process because she allegedly did not receive personal service of notices.
