Case Digest (G.R. No. 68102)

Facts:

  • The Accident
    • On January 8, 1977 at about 9–10 a.m., a head-on collision occurred on Pulong Pulo Bridge (MacArthur Highway, Pampanga) between:
      • An International Loadstar cargo truck (Plate No. RF912-T), owned by respondents Tayag and Manalo and driven by their employee Ruben Galang, traveling southward.
      • A Ford Escort car (Plate No. S2-850 Pampanga), driven by Jose Koh, traveling northward.
    • As a result, Jose Koh, his daughter Kim Koh McKee and their babysitter Loida Bondoc were killed; Araceli Koh McKee and her sons George and Christopher Koh McKee suffered serious injuries.
  • Circumstances Surrounding the Collision
    • Two boys suddenly darted into the path of the northbound Escort about ten meters before the bridge’s southern end. To avoid them, Jose Koh honked, swerved left into the truck’s lane, then braked while attempting to return to his lane.
    • The truck did not slow down or swerve; skid-mark measurements and a police sketch showed the truck partly straddling the center line. Galang admitted to traveling at “30 miles (48 kilometers) per hour,” exceeding the 30 km/h bridge-speed limit.
  • Civil and Criminal Proceedings
    • Civil Case No. 4477 (filed Jan. 31, 1977) by heirs of Jose Koh and Loida Bondoc sought indemnities, moral and exemplary damages, burial and litigation expenses.
    • Civil Case No. 4478 (filed Jan. 31, 1977) by heirs of Kim Koh McKee and the injured passengers sought similar relief plus medical and lost-earnings claims.
    • Defendants counterclaimed for damages and attorney’s fees and filed motions to dismiss or consolidate; in September 1978, both civil suits were consolidated under Branch III.
  • Trial Court Decisions
    • Criminal Case No. 3751 (filed Mar. 1, 1977): On Oct. 1, 1980, Judge Capulong convicted Galang of reckless imprudence resulting in multiple homicide and injuries, imposed imprisonment and ordered indemnities to the victims’ heirs.
    • Civil Cases: On Nov. 12, 1980, Judge Castaneda dismissed petitioners’ complaints and granted respondents’ counterclaims for moral and exemplary damages, attorney’s fees and litigation expenses.
  • Appellate History
    • Galang’s conviction was affirmed by the Court of Appeals on Oct. 4, 1982; this Court denied further review in April 1983.
    • Petitioners appealed the civil-case dismissal to the Intermediate Appellate Court (IAC). On Nov. 29, 1983, the IAC reversed the trial court and awarded petitioners damages. On Apr. 3, 1984, the IAC reconsidered and reinstated the trial court’s dismissal.

Issues:

  • Did the IAC’s April 3, 1984 Resolution err by disregarding the driver-admissions and record evidence and relying on mere presumptions?
  • Is the criminal conviction of Galang binding in the independent civil actions?
  • Which party’s negligence was the proximate cause of the collision: Jose Koh (car driver) or Ruben Galang (truck driver)?
  • Does the “emergency rule” exonerate Jose Koh’s maneuver to avoid the children?
  • Are respondents liable as employers under Civil Code Article 2180, and did they prove the “diligence of a good father of a family” defense?
