Facts:
On August 24, 2010, the Supreme Court en banc resolved consolidated petitions (G.R. Nos. 162335 & 162605) involving Lot No. 823 of the Piedad Estate in Quezon City, a friar land acquired by the government under Act No. 1120 of April 1904. Petitioners Severino M. Manotok IV, Froilan M. Manotok, and other Manotok family members (represented by their attorney-in-fact Rosa R. Manotok) relied on a chain of title dating from a 1919 Sale Certificate No. 1054 and its subsequent assignments (1920, 1923), a 1932 deed of conveyance signed by the Director of Lands, and Title Certificate No. 22813 issued by the Rizal Register of Deeds. After a 1988 fire destroyed Quezon City land records, they secured TCT No. RT-22481 (372302) by administrative reconstitution in 1991. Respondents – the heirs of Homer L. - Friar Lands and Lot 823
- Act No. 1120 (Friar Lands Act, 1904) transferred the Piedad Estate in Quezon City (then Rizal) from religious orders to the Philippine Government under Original Certificate of Title (OCT) No. 614.
- Lot 823 of Piedad Estate (342,945 m²) formed part of Friar Lands administered by the Director of Lands.
- Loss of Records and Initial Registrations
- On June 11, 1988, a fire destroyed the Quezon City Registry of Deeds, including TCT No. 372302 covering Lot 823.
- In 1991 the Manotoks secured administrative reconstitution of TCT No. 372302 (renumbered RT-22481).
- In 1996 the Barques filed for reconstitution of TCT No. 210177 (their claim to Lot 823), producing Subdivision Plan Fls-3168-D.
- Intervention by Manahans and Government Inquiries
- Felicitas and Rosendo Manahan claimed a 1939 Sale Certificate No. 511/Assignment of Sale Certificate No. 511 by which they asserted title, and petitioned the OSG and LMB for cancellation of the Manotok title.
- The LMB and DENR-NCR investigated:
- LMB Legal Division (Mandar/Tacorda) and NBI issued Chemistry Report C-99-152 (1999), finding Manotok documents not “as old as” they purport (ball-pen ink, artificial aging).
- DENR Undersecretary (Dela Peña, 2000) and LMB OIC-Director (Adobo, 2000) recommended cancellation of TCT RT-22481 and issuance of Deed of Conveyance No. V-200022 (Oct 30, 2000) to Felicitas Manahan.
- Remand and Commissioners’ Report
- Supreme Court (En Banc, Dec 18, 2008) set aside First Division rulings and remanded to the CA for fresh evidence on:
- Valid Government alienation under Act 1120 supporting the Manotok title.
- Claims of Barques and Manahans affecting Manotok title.
- CA’s Special First Division (Apr 12, 2010) issued a 219-page Commissioners’ Report finding:
- Manotok title rests on sale certificates and deeds of conveyance lacking Secretary’s approval (Act 1120 § 18).
- Barque documents and plans are spurious; their title invalid.
- Manahan Sale Certificate unsubstantiated or stale; Deed V-200022 invalid (lacking Secretary’s approval).
