Facts:

  • Mabuhay Shipping Services, Inc. (MSSI) hired Romulo Sentina as a 4th Engineer for and in behalf of Skippers Maritime Co., Ltd. to work aboard M/V Harmony I for a period of one year.
  • Sentina reported for duty aboard the vessel on July 13, 1987.

  • On January 16, 1988 at about 3 p.m., while M/V Harmony I was docked alongside Drapetona Pier, Piraeus, Greece, Sentina arrived aboard the ship from shore leave visibly drunk.
  • Sentina went to the messhall, took a fire axe, and challenged those eating therein.
  • Shipmates pacified Sentina and led him to his cabin.
  • Later, Sentina went out of his cabin and again proceeded to the messhall, where he became violent.

  • Ero touched his head and noticed blood; this infuriated Ero and led to a fight between him and Sentina.

  • After the incident, Ero was arrested by Greek authorities and jailed in Piraeus.
