Facts:
In Land Bank of the Philippines v. Musni, et al. (G.R. No. 206343, February 22, 2017), petitioner Land Bank of the Philippines sought to uphold its title to a foreclosed lot in Comillas, La Paz, Tarlac, originally registered under TCT No. 07043 in the name of Jovita Musni. Respondent Lorenzo Musni, as compulsory heir of Jovita, filed before the Regional Trial Court (RTC) of Tarlac City a complaint for reconveyance and cancellation of TCT No. 333352 against spouses Ireneo and Nenita Sonza Santos, their brother Eduardo Sonza, and Land Bank. Musni alleged that Nenita had falsified a Deed of Sale transferring the property to herself and Eduardo, who then mortgaged it to Land Bank as security for a ₱1,400,000 loan. Upon the borrowers’ default, Land Bank foreclosed the mortgage, consolidated titles, and caused issuance of TCT No. 333352 in its name. Musni also secured a conviction of Nenita for falsification in Municipal Trial Court Criminal Case No. 4066-99. The RTC in June 2008 ruleCase Digest (G.R. No. 145578)
