Respondent filed a Comment (4 June 2007) arguing that complainant lacked legal personality to bring the administrative complaint and that the charge was a form of harassment because the Criminal Case had already been tried, decided and appealed. He admitted noncompliance with the relevant time standards (Circular No. 38-98), but explained operational difficulties: his court was the lone RTC in Camiguin with a caseload of 266 cases; absence of a Clerk of Court; only three stenographers (one seriously injured); reliance on a non‑computer-literate stenographer; and limited Public Attorney’s Office representation for the accused.

The Office of the Court Administrator (OCA) reported (15 October 2007) a finding of guilt for undue delay and recommended the range of penalties provided under Section 9, Rule 140 of the Rules of Court, but, considering that only a single case was involved and it had been decided albeit belatedly, recommended reduction to a fine of P2,000.00.
