Facts:
Johansen World Group Corporation and Anna Liza F. Hernandez v. Rene Manuel Gonzales III, G.R. No. 198733, October 10, 2012, Supreme Court Second Division, Carpio, J., writing for the Court. Johansen World Group Corporation (JWGC) and its executive Anna Liza F. Hernandez (petitioners) questioned the Court of Appeals' denial of their petition in CA-G.R. SP No. 117758, which affirmed the National Labor Relations Commission's (NLRC) finding that Rene Manuel Gonzales III (respondent) was illegally dismissed.Gonzales was hired on August 1, 1997 as JWGC’s General Manager under a compensation package and a flexible work schedule. He claimed to have substantially improved JWGC’s operations and sales. Tensions arose in mid‑2009 after comments by JWGC principal Hans Hernandez about Gonzales’s performance and when Gonzales called the spouses Hernandez a derogatory name in a text message on August 12, 2009. On August 24, 2009, Gonzales met with Anna Liza Hernandez, who, he says, told him he should resign or stop reporting for work and indicated they wanted him out; Gonzales understood this as being fired. Gonzales filed an illegal dismissal complaint on September 17, 2009 (NLRC Case No. RAB‑IV‑09‑01197‑09‑RI).
The Labor Arbiter dismissed the complaint on April 5, 2010, but awarded Gonzales his proportionate 13th month pay for 2009. Gonzales appealed to the NLRC (NLRC LAC No. 05‑001195‑10). On June 29, 2010, the NLRC reversed, finding Gonzales was illegally dismissed, and ordered payment of backwages, separation pay, and 13th month pay, but denied other monetary claims; its denial of reconsideration was resolved on December 14, 2010.
Petitioners sought certiorari with the Court of Appeals (CA‑G.R. SP No. 117758). On May 20, 2011 the Court of Appeals denied the petition and affirmed the NLRC, holding that Liza had already decided to termi...(Subscriber-Only)
