The private respondent Gaudencia de Quiroz filed a complaint with the National Labor Relations Commission (NLRC) alleging underpayment of wages, unpaid overtime, and wrongful dismissal. The case was referred to a Mediator‑Fact‑Finder, Atty. Luna C. Piezas, who conducted preliminary fact‑finding hearings (January 31 and February 6, 1973) and mediation hearings (February 16 and 22, 1973), received memoranda of the parties, and submitted a Preliminary Fact‑Finding Report (Feb. 7, 1973), a Mediation Report (Mar. 12, 1973), and an Additional Mediation Report (Mar. 17, 1973).
On March 22, 1973 the NLRC adopted the mediator’s findings and ordered the petitioners (the employers/proprietors) to pay Quiroz wage differentials of P2,609.00, overtime pay of P5,265.00, and separation pay of P1,200.00 — a total of P9,074.00 — within five days from finality. The petitioners appealed to Secretary of Labor Blas Ople, who, in a fuller decision dated May 18, 1973, affirmed the NLRC. The Secretary held that (a) the exemption in Republic Act No. 3470 (the NACIDA Act) applies only to persons working in their respective houses and does not exempt workers who work in an establishment; (b) the complainant’s records evidenced regular work and fixed salary (negating a proven piece‑rate arrangement), justifying overtime pay; (c) the dismissal followed the complainant’s sick leave and therefore separation pay was due; and (d) under Presidential Decree No. 21 the NLRC had original and exclusive jurisdiction over employer‑employee disputes and may adjudicate money claims arising from such relations.
