The petitioners are sisters Geraldine Gaw Guy and Grace Guy Cheu. Their father was naturalized as a Filipino in 1959, and the sisters were recognized as Filipino citizens at that time. Respondent Atty. Alvin Agustin T. Ignacio filed a complaint on March 5, 2004 with the Bureau of Immigration (BI) alleging the petitioners were Canadian citizens working illegally in the Philippines; the BI Special Prosecutor, Maricel U. Salcedo, subpoenaed the petitioners to produce documents. The petitioners moved to quash the subpoena (Duces Tecum / Ad Testificandum), but Salcedo denied the motion on May 14, 2004.

On June 1, 2004 the Board of Commissioners (BOC) of the BI filed a formal charge sheet accusing the petitioners of working without permit, fraudulently representing themselves as Philippine citizens, and failing to comply with the subpoena, invoking provisions of the Philippine Immigration Act of 1940, as amended. The petitioners filed a Petition for Certiorari with Damages and sought interim injunctive relief (TRO and writ of preliminary injunction) with the Regional Trial Court (RTC), Branch 37, Manila (docketed SCA No. 04-110179).

The RTC granted a TRO on June 28, 2004 and, after hearings, issued a writ of preliminary injunction on July 19, 2004 enjoining respondents from continuing deportation proceedings against the petitioners; the court required petitioners to post P50,000 bond. Public respondents and Atty. Ignacio separately filed petitions for certiorari with the Court of Appeals (CA): two petitions were raffled to the CA Eighth and Ninth Divisions (CA-G.R. SP Nos. 86298 and 86432). The Ninth Division annulled the RTC’s writ on January 6, 2005 and denied reconsideration on March 10, 2005; the Eighth Division likewise nullified the RTC orders in an April 29, 2005 decision. Petitioners filed petitions for review on certiorari with the Supreme Court: G.R. No. 167824 (challenging the Ninth Division decision) and G.R. No. 168622 (challenging the Eighth Division decision). G.R. No. 168622 was initially dismissed but later reinstated and consolidated with G.R. No. 167824. Petitioner Grace Guy Cheu died intestate on August 12, 2007 in the United States.
