The land at issue — an 83,300 sqm parcel in Cavinti, Laguna — was originally covered by Original Certificate of Title No. 2262 issued to the late Pedro Villanueva (April 2, 1924). Petitioners, who are his nephew and niece, asserted ownership under an unnotarized, Tagalog private deed of sale dated August 10, 1937 (Exhibit B) purportedly signed by Pedro Villanueva conveying the property to them for P500.00. Based on that private document the Original Certificate was cancelled and a Transfer Certificate of Title (TCT No. RT-6293) in petitioners' names issued on January 4, 1944; that title was later administratively reconstituted after wartime destruction of records by an Affidavit of Reconstitution of December 2, 1958.

In 1976 respondent Marta Villanueva vda. de Agana (daughter and heir of Pedro Villanueva) filed an Affidavit of Adverse Claim; two co-affiants later withdrew their adverse claim but Marta did not. Attempts at amicable settlement failed; a Deed of Conveyance and Release of Claim dated December 9, 1976 appears in the record, but petitioner claimed Marta refused to execute an affidavit of quitclaim. Petitioners then filed suit on February 3, 1977 for quieting of title and damages, asking the court to declare their ownership and to avoid the Release. Respondents countered that the 1937 deed was void ab initio and attacked petitioners' title.

The Court of First Instance (now Regional Trial Court) on January 20, 1982 declared the private 1937 document and the reconstituted TCT void, ordered reinstatement of OCT No. 2262 in Pedro Villanueva’s name and awarded possession and damages to defendants.
