Facts:
Rodolfo Fuentes et al. v. National Labor Relations Commission, 5th Division, Cagayan de Oro City; Agusan Plantations, Inc., and/or Chang Chee Kong, G.R. No. 110017, January 02, 1997, Supreme Court First Division, Bellosillo, J., writing for the Court.
Petitioners are seventy-five (75) employees who were regular workers of private respondent Agusan Plantations, Inc., employed at a palm plantation in Trento, Agusan del Sur since September 1982. Private respondent, alleging business losses and upon instructions from its head office in Singapore, sent notices of termination to the workers and filed a Notice of Retrenchment with the Department of Labor and Employment (DOLE).
On 31 October 1990 petitioners filed with the DOLE office in Cagayan de Oro City a complaint for illegal dismissal seeking reinstatement, backwages and damages against Agusan Plantations, Inc. and/or Chang Chee Kong. Respondents denied illegal dismissal and asserted that retrenchment was undertaken to prevent losses, that they had conducted grievance conferences with petitioners' labor representatives, and that the 30‑day notices of termination were duly served.
The Labor Arbiter rendered a decision in favor of petitioners, ordering separation pay equivalent to fifteen (15) days pay for every year of service plus salary differentials and attorney’s fees (the opinion cites this Labor Arbiter decision as having been rendered on 27 May 1992, while the dispositive later refers to a Labor Arbiter decision dated 27 March 1992). On appeal the National Labor Relations Commission (NLRC) reversed the Labor Arbiter (the opinion refers to the NLRC decision as dated 27 November 1992 in one place and 27 September 1992 in the dispositive).
Petitioners filed a special civil action for certiorari under Rule 65 alleging grave abuse of discretion amounting to lack or excess of jurisdiction by the NLRC in holding that the retrenchments w...(Pro-only)
