Vice-Mayor Marcelina S. Engle, Petitioner, vs. Commission on Elections En Banc and Winston B. Menzon, Respondents, G.R. Engle sought relief from COMELEC resolutions that denied due course to and cancelled her certificate of candidacy (COC), annulled her proclamation as Vice‑Mayor of Babatngon, Leyte, and proclaimed private respondent Winston B. Menzon in her stead.

In the May 13, 2013 elections petitioner substituted for her late husband, James L. Engle, who died February 2, 2013; she filed her COC as his substitute on February 22, 2013. Private respondent Menzon filed on February 25, 2013 a Petition to Deny Due Course and/or Cancel Certificate of Candidacy, alleging that James Engle had been classified by the COMELEC Law Department as an independent candidate because Lakas‑CMD failed to timely submit the authority designating Ferdinand Martin G. Romualdez as an authorized signatory for CONAs, thus precluding substitution under the rules. Petitioner countered that James Engle was a bona fide Lakas‑CMD nominee, that Romualdez was validly authorized (producing an Authority to Sign dated September 11/12, 2012), and that the petition invoked the wrong remedy because Section 78 of the Omnibus Election Code (OEC) limits cancellation for false material representations.

While the cancellation petition was pending, the May 13, 2013 election occurred; James Engle’s name remained on the ballot and the Municipal Board of Canvassers proclaimed petitioner the winner with 6,657 votes versus Menzon’s 3,515. On July 5, 2013 the COMELEC Second Division issued a Resolution denying due course to and cancelling petitioner’s COC, annulling her proclamation and ordering a special board to proclaim Menzon. The Second Division found no material misrepresentation in the COC but nonetheless cancelled it because Romualdez’s authority to sign CONAs had been belatedly submitted and James Engle was therefore an independent candidate who could not be substituted. Petitioner filed for reconsideration before the COMELEC En Banc, which denied reconsideration in its January 20, 2015 Resolution affirming the Second Division.

Petitioner then filed a petition for certiorari and prohibition under Rule 65 of the Rules of Court in this Court. During the petition’s pendency the COMELEC En Banc issued, on February 3, 2015, a Writ of Execution in the SPA case to implement its resolutions.
