Plaintiff-appellant Juan Edades sued Severino Edades and others in the Court of First Instance of Pangasinan seeking a declaratory judgment to determine his hereditary rights in the property of his alleged father, Emigdio Edades, and incidentally to have his status recognized as an illegitimate son of Emigdio. He alleged that he was born of Emigdio and Maria de Venecia while Emigdio was married to Maxima Edades and that he had continuously possessed the status of illegitimate child by acts of his father and the legitimate children; he claimed entitlement to a share of Emigdio’s estate and sought a judicial determination to avoid future contests.

Instead of an answer, defendants filed a motion to dismiss for failure to state a cause of action; the trial court sustained the motion and dismissed the complaint, holding that a declaratory relief action cannot be used merely to clear doubts about status or to compel recognition of rights not yet accrued (specifically succession rights prior to the death of the decedent).
