Facts:
On May 11, 2007, at around 12:00 noon, Erwin Libo-on Dela Cruz, an on-the-job trainee aboard an inter-island vessel, arrived at the Cebu Domestic Port to return to Iloilo. After briefly leaving his single bag with a porter to purchase a ticket, he placed it on the port’s X-ray screening machine. Operator Cutie Pie Flores observed what appeared to be three firearms and alerted baggage inspector Archie Igot.
