Case Digest (G.R. No. 37379)
Facts:
In Antonia L. de Jesus et al. v. Cesar Syquia, decided November 28, 1933, Antonia Loanco de Jesus, assisted by her mother Pilar Marquez as next friend of her two minor children, Ismael and Pacita Loanco, brought suit in the Court of First Instance of Manila against Cesar Syquia. The complaint sought ₱30,000 in damages for breach of a marriage promise, an order compelling recognition of both infants as Syquia’s natural children, and monthly support of ₱500 for all three. Syquia, a 23-year-old bachelor of means, had met Antonia in June 1930 when she became cashier at his brother-in-law’s Tondo barber shop. Their illicit liaison resulted in her pregnancy and the birth of a son on June 17, 1931. Syquia acknowledged paternity in a written note to the officiating priest and in subsequent letters to Antonia, arranged hospital confinement under Dr. Crescenciano Talavera, and sheltered mother and child at 551 Camarines Street for about a year, paying all household expenses. Upon Antonia’Case Digest (G.R. No. 37379)
Facts:
- Parties and cause of action
- Plaintiffs: Antonia Loanco de Jesus (in her own right) and Pilar Marquez (as next friend of infants Ismael and Pacita Loanco) sought
- ₱30,000 damages for breach of marriage promise
- Recognition of Ismael and Pacita as natural children of Cesar Syquia
- Maintenance of ₱500 per month for the three
- Defendant: Cesar Syquia appealed the requirement to recognize Ismael and to pay maintenance; plaintiffs appealed denial of other relief
- Relationship and birth of children
- Antonia, age 20, employed as cashier in her brother-in-law’s barber shop in Tondo; Cesar Syquia, age 23, unmarried and affluent, began an amorous relation with her
- Antonia became pregnant; Syquia wrote a note to the padre (“The baby due in June is mine…”) and subsequent letters during her pregnancy acknowledging “junior”
- Syquia arranged Dr. Crescenciano Talavera and hospitalization at St. Joseph’s; the baby, later named Ismael Loanco, was born on June 17, 1931
- The three lived together in “regular family style” for about one year at No. 551 Camarines Street, expenses defrayed by Syquia
- Upon signs of a second pregnancy, Syquia abandoned Antonia and later married another woman; at the christening he caused the child to be named Ismael Loanco instead of “Cesar Syquia, Jr.”
Issues:
- Whether the note to the padre and the subsequent letters constitute an “indisputable paper…expressly acknowledging paternity” under Civil Code art. 135(1)
- Whether acknowledgment may be established by combining multiple documents rather than a single writing
- Whether Ismael Loanco had “uninterrupted possession of the status of a natural child” justified by the father’s conduct under art. 135(2)
- Whether Antonia may recover damages for breach of promise to marry under the Civil Code
- Whether there is proof to require recognition of the second infant, Pacita Loanco
- Whether the maintenance award should be modified
