Petitioners Manuel Cudiamat, Jose Sugay, and Marketing & Services, Inc. sought certiorari and prohibition with preliminary injunction against an order of the Court of First Instance of Rizal, Branch VII, which restrained them from carrying out or implementing an award for the supply of a police call and signal box system for the City of Manila. Respondent International Telephone & Telegraph (Philippines) Inc. (ITT, (Phil.)) filed Civil Case No. 8394 in the Court of First Instance of Rizal on 25 September 1964, seeking a preliminary injunction to stop implementation of the award. After the court granted a writ of preliminary injunction on 29 October 1964 and denied petitioners’ motion for reconsideration on 12 January 1965, petitioners filed the present petition; on 1 March 1965, the Supreme Court issued a preliminary injunction enjoining enforcement of the lower court’s order pending resolution, and the Court resolved the controversy on a single issue on jurisdiction.
