Facts:
In Ricardo Cuartero v. Court of Appeals (287 Phil. 280, August 5, 1992), petitioner Ricardo Cuartero filed on August 20, 1990 a complaint for sum of money with damages against spouses Roberto and Felicia Evangelista before the Regional Trial Court (RTC) of Quezon City, Branch 98, docketed as Civil Case No. Q-90-6471. He prayed for a writ of preliminary attachment and on August 24, 1990 the RTC issued an ex parte order granting that prayer. Pursuant thereto, the writ was issued on September 19, 1990, and on September 20, 1990 Deputy Sheriff Ernesto L. Sula simultaneously served the writ, summons, the complaint, and the August 24 order on the Evangelistas at their residence and levied their nonexempt properties to secure petitioner’s claim of ₱2,171,794.91. The spouses moved on September 28, 1990 to set aside the order and discharge the writ, but on October 4, 1990 the RTC denied that motion for lack of merit.
