Facts:
Civil Service Commission v. Peter E. Nierras, G.R. No. 165121, February 14, 2008, the Supreme Court En Banc, Quisumbing, J., writing for the Court. Petitioner is the Civil Service Commission (CSC); respondent is Peter E. Nierras, then Acting General Manager of the Metro Carigara Water District, Leyte. The complaint was brought by Olga C. Ona, a secretary of the Local Water Utilities Administration (LWUA).On July 17–18, 1994, Ona traveled to Leyte on LWUA business and was endorsed to Nierras to assist in forming the San Isidro Water District. After an official briefing in San Isidro, Nierras invited Ona to stay overnight at his farm in Calubian. Ona alleges that, while asleep on a balcony, Nierras crept beside her, was half-naked with his pants unzipped, grabbed and attempted to pull her under a blanket; Ona screamed and escaped. Nierras denied the sexual-harassment charge, claiming Ona consented to sleep at the farm and that he merely used an unused portion of the blanket to shield against mosquitoes.
Ona filed an incident report with LWUA and, on October 28, 1994, an affidavit with the CSC charging Nierras with sexual harassment, grave misconduct, and conduct unbecoming. The CSC found a prima facie case as to Nierras, dismissed charges against two supervisors for lack of collusion, and on September 29, 2000 found Nierras guilty of grave misconduct and imposed dismissal from the service. Nierras’ motion for reconsideration before the CSC was denied.
Nierras appealed to the Court of Appeals. On March 5, 2004 the Court of Appeals affirmed the CSC’s finding of grave misconduct and the penalty of dismissal. After Nierras’ motion for reconsideration, the Court of Appeals on July 27, 2004 partially amended its March 5 decision by reducing the penalty to six months’ suspension without pay, relying on this Court’s Resolution in Veloso v.
