Facts:
Petitioner Asan "Sonny" Camlian and private respondent Leonardo A. Pioquinto ran for mayor of Isabela, Basilan in the May 8, 1995 elections. Private respondent was initially proclaimed winner and assumed office, but petitioner filed an electoral protest and the Regional Trial Court (RTC) of Basilan, Branch II later declared petitioner the duly elected mayor in a decision dated January 22, 1996, after finding him to have received 5,836 votes versus private respondent’s 2,291.After private respondent filed a notice of appeal on the same day, petitioner moved for execution pending appeal. On January 31, 1996, the RTC granted the motion and petitioner assumed office pursuant to the writ. Private respondent then filed with the COMELEC a petition for certiorari with prayer for preliminary injunction and a temporary restraining order, resulting in the COMELEC setting aside the RTC’s execution order through resolutions dated February 8, 1996 and April 16, 1996.
