Case Digest (G.R. No. 140519)
Facts:
In January 1996, Apolonio Galang offered to sell an 80-square meter parcel of land located in an undisclosed location to Salvador Buce for a total purchase price of PHP 64,000. The parties executed a document titled "Conditional Sale" which, in substance, was a contract to sell. Under the agreement, Salvador paid a down payment of PHP 10,000 and was to pay the remaining PHP 54,000 in monthly installments of PHP 1,000 starting April 1, 1996, with a 3% monthly interest penalty on late payments. Salvador was allowed to take possession and make improvements on the property upon signing. From February 1996 to July 2007, Salvador paid 90 irregular installments totaling PHP 72,000 but did not include the monthly interest penalties. After Apolonio’s death, Salvador demanded the execution of a deed of absolute sale from Apolonio’s heirs, who refused. Salvador filed a complaint for specific performance before the Regional Trial Court (RTC), contending that he had fully paid the purchase pCase Digest (G.R. No. 140519)
