Facts:
In the May 11, 1987 elections for the Fourth District of Pampanga, Marciano M. Pineda (LDP) was proclaimed winner over Dr. Emigdio A. Bondoc (NP) by 3,300 votes. Bondoc timely filed an election protest before the House of Representatives Electoral Tribunal (HRET), composed of nine members: three Supreme Court Justices (Herrera, Cruz, Feliciano) and six Congressmen chosen on proportional party basis (four LDP, one NP, one former LDP).
