Facts:

Bo applied in 1993 with the DENR‑CENRO Legazpi for a foreshore lease of a 10,000 sq. m. lot at Palale Beach, San Isidro, Malilipot, Albay. While his application was pending he introduced improvements (a cottage, coconut trees), secured a barangay permit, paid occupation fees, and had a DENR survey and appraisal done. In April 2003, shortly before the DENR released notice for bidding, Bo’s cottage and coconut trees were destroyed; he filed a police blotter entry naming Barangay Captain Bello and Kgd. Bisona as leading the removal, allegedly in defiance of a DENR directive.
The barangay opposed the posting of the Notice to Lease and filed a protest with DENR, claiming the land should be for barangay projects. The protest was referred to DENR‑PENRO. LMO Santiago Olfindo conducted an ocular inspection on October 21, 2003, and prepared a matrix listing improvements and the identified owners of cottages on the area; the matrix identified Joep hil C. Bien as one of the owners of twenty‑two cottages allegedly constructed in March 2003. The DENR Regional Executive Director relied on the PENRO findings to deny the barangay’s protest and to uphold the bidding.
Bo brought an administrative complaint to the Office of the Ombudsman, accusing barangay officials and others (including Bien) of conniving to remove his improvements so they could erect their own cottages. Bien denied ownership, submitting an affidavit of Renaldo Belir and a barangay permit receipt asserting that Belir—not Bien—built the cottage. The Deputy Ombudsman for Luzon found Bien and other respondents administratively liable for Abuse of Authority and recommended three months suspension without pay.
