Case Digest (G.R. No. 228509)
Facts:
In Rosendo Alba, Minor, represented by his mother and natural guardian, Armi A. Alba, and Armi A. Alba, in her personal capacity vs. Court of Appeals and Rosendo C. Herrera (G.R. No. 164041, July 29, 2005), private respondent Rosendo C. Herrera petitioned the Regional Trial Court of Manila, Branch 37, on October 21, 1996 for cancellation of the entries in the birth certificate of “Rosendo Alba Herrera, Jr.”—namely, the surname “Herrera,” reference to Herrera as father, and the alleged marriage to Armi on August 4, 1982 in Mandaluyong. He supported his claim with certifications from the Civil Registrar of Mandaluyong and the National Statistics Office showing no record of his marriage to Armi. The court issued an order fixing the hearing, served and published notice per Rule 108, but Armi, served at No. 418 Arquiza St., Ermita, Manila, did not appear; the notice was returned unserved. On April 1, 1997, the RTC rendered judgment canceling the entries; this became final on June 2,Case Digest (G.R. No. 228509)

- The reference to Herrera as the father; and
- The alleged marriage (August 4, 1982) to the child’s mother, Armi A. Alba (“Armi”).

- Annulment of Judgment Proceeding
- November 24, 2000 – Armi and the minor filed a petition for annulment of judgment in the CA, alleging extrinsic fraud and lack of jurisdiction over their persons, claiming they first learned of the RTC decision in Feb 1998 via San Beda College notice.
- They asserted Herrera knew Armi’s actual address (Unit 302, Plaza Towers Condominium, 1175 L. Guerrero St.) from their prior cohabitation (1982–1988) and support until 1998; evidence offered included:
- Titles and homeowner’s dues receipts;
- Photocopy of 1991 deed of sale transferring the condominium unit to Armi;
- Love letters/notes and affidavits of Armi and her sister.
- February 27, 2004 – CA dismissed the annulment petition for lack of extrinsic fraud and proper service; May 14, 2004 – motion for reconsideration denied. Petitioner filed certiorari under Rule 65 before the SC.
Issues:
- Jurisdiction and Nature of the Proceeding
- Whether the RTC acquired jurisdiction over Armi and the minor in a petition for correction of entries.
- Whether service by publication and at the address in the birth certificate satisfied due process.
- Extrinsic Fraud
- Whether Herrera fraudulently concealed knowledge of Armi’s true address to prevent her appearance.
- Whether the evidence sufficiently proved Herrera’s knowledge and intent.
- Procedural Remedy
- Whether certiorari under Rule 65 is the proper remedy against the CA decision.
- Whether petitioners should have filed a petition for review under Rule 45.
- Substantive Merits
- Whether annulment of the RTC decision would produce any concrete relief.
- Whether the minor’s surname must revert to “Alba” under Article 176, Family Code.
