Facts:
The petitioner, Homobono A. Adaza, was elected Governor of Misamis Oriental in the January 30, 1980 elections, took his oath, and started serving on March 3, 1980. The respondent, Fernando Pacana, Jr., was elected Vice-Governor of the same province in the same elections and likewise qualified and assumed office on March 3, 1980. Their respective terms were to expire on March 3, 1986. On March 27, 1984, Pacana filed his certificate of candidacy for the May 14, 1984 Batasang Pambansa elections, with Adaza following on April 27, 1984. In the elections, Adaza won as Mambabatas Pambansa, while Pacana lost. Adaza took his oath as MP on July 19, 1984, and acted accordingly. Meanwhile, Pacana took his oath as Governor on July 23, 1984 before President Ferdinand E. Marcos and began performing the duties of governor on July 25, 1984.
