Case Digest (G.R. No. 202408)
Facts:
In G.R. No. 202408, 202409, and 202412, petitioners Farouk B. Abubakar, Ulama S. Baraguir, and Datukan M. Guiani, all then officials of the DPWH-ARMM, challenged the Sandiganbayan’s December 8, 2011 Decision and June 19, 2012 Resolution convicting them of multiple counts of graft under Section 3(e) of Republic Act No. 3019. The facts date from 1991–1992, when ₱615 million was transferred from the national government to the ARMM for provincial infrastructure. A COA special audit led by Heidi Mendoza uncovered: (a) overpayments of ₱17.684 million due to bloated accomplishment reports; (b) ₱14.4 million in unauthorized advances for sub‐base aggregates; (c) public bidding conducted without completed engineering surveys; and (d) an unnecessary ₱200,000 survey costing above limits. On July 31, 1998, the Office of the Ombudsman filed separate informations in Sandiganbayan Criminal Cases Nos. 24963–24983 against the three petitioners and other DPWH-ARMM officials. After extensive trialCase Digest (G.R. No. 202408)

- Are Abubakar and Baraguir entitled to a new trial for alleged counsel incompetence?
- Was there selective prosecution violating equal protection?
- Did the evidence establish guilt beyond reasonable doubt under RA 3019 § 3(e)?
- Should Abubakar, Baraguir, and Guiani be exonerated under the Arias good-faith doctrine?
