Authority to Initiate Complaints
- The Ministry of Labor and Employment (now Department of Labor and Employment) has the authority to initiate complaints against illegal recruiters.
- Law enforcement officers may also initiate complaints under this provision.
Powers of the Minister of Labor and Employment
- The Minister or authorized representatives can arrest and detain non-licensees or non-authorized recruiters after proper investigation.
- Arrest and detention occur if the activities are deemed dangerous to national security or public order, or if they lead to exploitation of job-seekers.
Closure of Unauthorized Recruitment Entities
- The Minister can order the closure of companies, establishments, or entities engaged in overseas recruitment without proper license or authorization.
Penalties and Enforcement
- Illegal recruitment is punishable under Article 39 of the Labor Code.
- Strong enforcement measures are provided to curb illegal recruitment activities.
Effectivity
- The decree takes effect immediately upon promulgation on May 1, 1984.
