Executive Order No. 452 aims to ensure the security and protection of registered vendors in the Philippines, promoting their livelihood and addressing issues faced by the poorest sectors of society, through the establishment of the Inter-Agency Council on the Security of Registered Vendors and guidelines for vendor registration and protection against arbitrary eviction and demolition.

Law Summary

Functions of the Council

  • Formulate policies and programs for protection and security of registered vendors.
  • Issue Implementing Rules and Regulations (IRR) within 45 days of effectivity in consultation with all concerned sectors and consistent with existing laws.
  • Periodically review and revise the IRR as necessary.
  • Monitor and ensure effective implementation of the Executive Order provisions.
  • Submit quarterly reports to the President.
  • Perform other functions as directed by the President.

Coverage and System of Registration

  • Applies to vendors in all cities and municipalities nationwide.
  • Each city and municipality must establish a system for registration and permit issuance to vendors.
  • Aims to protect the rights of vendors and the interests of consumers and the public.

Designation of Workplaces

  • Cities or municipalities will identify and designate viable workplaces for vendors.
  • Consultation required with vendors, affected community, and other sectors/groups.
  • Workplaces include markets, vacant areas near markets, and other public spaces designated for vending.
  • System for assigning vending spaces to registered vendors must be designed.

Empowerment of Vendors

  • National Government Agencies must support vendors' self-development into healthy, informed, environmentally aware, progressive and productive citizens.
  • Vendors encouraged to organize into associations reflective of their ideals and aspirations.

Policy on Eviction and Demolition

  • Vendors shall not be arbitrarily deprived of livelihood by unjust ejection or demolition of stalls.
  • This protection does not apply to vendors who started occupying the premises after the Executive Order's effectivity.

Separability Clause

  • Declaration of any provision as unconstitutional or illegal does not affect the remaining provisions.

Repealing Clause

  • All inconsistent orders, issuances, rules, and regulations are repealed or modified accordingly.

Effectivity

  • The Executive Order takes effect immediately upon issuance.
