Republic Act No. 9136, also known as the Electric Power Industry Reform Act of 2001 (EPIRA), provides for the establishment of the Wholesale Electricity Spot Market (WESM).
The Department of Energy (DOE) is responsible for establishing the Wholesale Electricity Spot Market (WESM).
The National Power Corporation (NPC) and the Power Sector Assets and Liabilities Management Corporation (PSALM) were designated as the Default Wholesale Suppliers (DWS) of the Philippine WESM.
The designation was for a period of one (1) year from the start of WESM commercial operations in Luzon and Visayas.
Resolution No. 18, Series of 2007 extended the effectivity of the Default Wholesale Suppliers until June 26, 2007, or until superseded by another ERC Resolution, whichever comes earlier.
ERC Resolution No. 11, Series of 2008 promulgated the Rules for the Default Wholesale Supplier Arrangements (DWSA) for the Wholesale Electricity Spot Market, as amended.
The Rules shall be implemented in Luzon from June 26, 2008, until one (1) year after the start of open access and retail competition, unless earlier discontinued by the Department of Energy (DOE).
The Department of Energy (DOE) has the authority to discontinue the Default Wholesale Supplier Arrangements before the end of the specified period.
The Resolution took effect on the fifteenth (15th) day following its publication in a newspaper of general circulation.
Copies were to be furnished to the University of the Philippines Law Center-Office of the National Administrative Register (UPLC-ONAR) and all entities engaged in the transmission and distribution of electricity.
