This Order applies to senior citizens who are Filipino citizens as defined in Section 2 (a) of RA No. 9994 and retailers as defined under Section 2 (c) of the Order.
Basic necessities include items such as rice, corn, bread (excluding pastries and cakes), fresh, dried and canned fish and other marine products, fresh pork, beef and poultry meat, fresh eggs, fresh and processed milk, fresh vegetables including root crops, coffee and coffee creamer, sugar, cooking oil, powdered, liquid, bar laundry and detergent soap, firewood, charcoal, and candles.
Prime commodities include fresh fruits, flour, dried, processed and canned pork, beef and poultry meat, dairy products not listed under basic necessities, canned sardines and tuna, noodles, onions, garlic, geriatric diapers, herbicides, poultry, swine and cattle feeds, veterinary products for poultry, swine and cattle, nipa shingle, plywood and construction nails, batteries, electrical supplies and light bulbs, and steel wire.
A retailer is any natural or juridical person engaged in the business of selling consumer products directly to consumers, including supermarkets, grocery stores, convenience and mini-convenience stores and shops. It excludes stalls in food courts, food carts, food vendors, sari-sari stores with capitalization less than Php100,000, public and private wet markets, atalipapaa, and cooperative stores.
A senior citizen is any Filipino citizen, resident of the Philippines, who is sixty years old and above. It may also include senior citizens with dual citizenship who prove Filipino citizenship and at least six months residency in the Philippines.
Senior citizens shall enjoy a special discount of five percent (5%) on the regular retail price of basic necessities and prime commodities, not exempt from VAT, with a maximum purchase amount of Php1,300 per calendar week.
Senior citizens must present a valid and original Senior Citizen Identification Card issued by the Office of Senior Citizens Affairs (OSCA). Retailers may also require other government ID indicating age if there is reasonable doubt.
The purchase booklet documents purchases of basic necessities and prime commodities and contains the senior citizen’s name, list of covered items, retailer name and address, date of purchase, and amount spent.
Retailers shall provide a special express lane for senior citizens; if none is available, priority service must be given to them.
No, a senior citizen cannot claim multiple discounts. If the retailer offers a higher discount, the senior citizen must choose either that or the 5% discount. A senior citizen with PWD status must use either their OSCA ID or PWD ID to avail a 5% discount, but not both together.
A senior citizen may appoint a representative via written authority who must present a valid government-issued ID, the senior citizen’s OSCA-issued ID, and an authorization letter to transact on their behalf.
Penal and administrative sanctions prescribed under RA No. 9994 shall apply for violations.
This Order repeals DTI Department Administrative Order No. 3, Series of 2005, and DA Administrative Order No. 37, Series of 2005.
It took effect upon its publication in a national newspaper of general circulation.
