Facts:
Remedios O. Yap, the petitioner, filed a case against Rover Maritime Services Corporation, Mr. Ruel Benisano, and/or UCO Marine Contracting W.L.L., the respondents. The deceased, Dovee M. Yap, had been a seafarer employed by the respondents in various roles for a span of ten years. His last employment contract commenced on July 15, 2005, as a Third Mate aboard the vessel UCO XX, with a basic monthly salary of $600. He boarded the vessel on July 23, 2005, but met with an accident on the final day of his contract, July 23, 2006, wherein he slipped while inspecting a lifeboat, suffering significant injury. Following this incident, he was hospitalized in Bahrain for two weeks and subsequently repatriated to the Philippines on August 17, 2006. On August 19, 2006, Dovee Yap was admitted to the Doctors Medical Center in Iloilo City and continued treatment thereafter, eventually diagnosed with squamous cell carcinoma of the lungs with metastasis.

Case Digest (G.R. No. 198342)
Facts:
- Employment and Contractual Background
- Dovee M. Yap was a seafarer employed by Rover Maritime Services Corporation, its foreign principal UCO Marine Contracting W.L.L., and Mr. Ruel Benisano for a continuous period of ten (10) years in various capacities under different contracts of employment.
- In his last contract dated July 15, 2005, he was hired as Third Mate aboard the vessel UCO XX for one (1) year with a basic monthly salary of US$600.00.
- He embarked on the vessel on July 23, 2005, commencing his deployment under the terms of the employment contract incorporating the POEA Standard Employment Contract and relevant DOLE issuances.
- The Accident and Subsequent Medical Developments
- On July 23, 2006, the last day of his contract, while inspecting a lifeboat, Dovee Yap suffered an accident by slipping and hitting his back against a steel lifeboat ladder.
- Following the incident, he was taken to a hospital in Bahrain where he was confined for two (2) weeks.
- After being repatriated to the Philippines on August 17, 2006, he received further medical treatment:
- Admitted at Doctors Medical Center in Iloilo City for three (3) weeks.
- Later confined at the (Iloilo) Western Visayas Medical Center, where he was diagnosed with squamous cell carcinoma of the lungs with metastasis to the spine—and possibly the brain.
- Filing of the Claim and Changes in the Party Status
- On July 17, 2007, Dovee Yap filed a complaint for permanent disability benefits, sick wages, reimbursement of expenses (hospital, medical, doctors’ fees), actual, moral, exemplary damages, and attorney’s fees against the respondents.
- While the case was pending, Dovee Yap died on August 19, 2007, from multiple complications including cancer and pneumonia.
- His widow, Remedios O. Yap, substituted him as the party-complainant, and the claim was subsequently converted from disability benefits to death benefits.
- Administrative Proceedings and Decisions
- The Labor Arbiter dismissed the complaint on February 28, 2008, holding that:
- The injury sustained was not the proximate cause of his death, which resulted from illnesses (e.g., tuberculosis, pneumonia, and squamous cell carcinoma) that did not manifest during his employment.
- The death occurred beyond the period of his contract and was not work-related despite the accident.
- The National Labor Relations Commission (NLRC), in its January 29, 2010 decision, reversed the Labor Arbiter’s ruling and ordered the payment of death benefits based on the premise that the July 23, 2006 accident was the proximate cause of his subsequent illness and death.
- The respondents, after the NLRC denied their Motion for Reconsideration, appealed to the Court of Appeals (CA) via a Petition for Certiorari contesting the NLRC’s award of death benefits.
- On June 6, 2011, the CA reversed the NLRC decision, emphasizing that:
- Dovee Yap’s one-year employment contract had expired on July 23, 2006 (or ceased upon his repatriation on August 17, 2006).
- His death occurred on August 19, 2007, which was over a year after the termination of his employment.
- There was insufficient evidence to establish a causal connection between the accident and the illnesses that caused his death.
- Petitioners (Remedios O. Yap) subsequently raised additional arguments based on certain provisions of the Collective Bargaining Agreement (CBA) and relevant contractual clauses but the CA maintained its ruling in favor of the respondents.
- Arguments and Grounds Raised in the Petition for Review
- Petitioners accused the CA of grave abuse of discretion and error in reversing the NLRC decision, alleging that:
- The CA disregarded the clear provisions of the CBA, which purportedly provided that the death was compensable if directly attributable to the injury or illness incurred during employment.
- The petitioners would suffer irreparable injustice if the erroneous decision was not rectified.
- The primary issue was whether Dovee Yap’s death was work-related and occurred during his employment contract, thus entitling his beneficiaries to death benefits under the POEA Standard Employment Contract and relevant CBA provisions.
Issues:
- Whether the accident sustained by Dovee Yap on July 23, 2006 was the proximate cause of the pulmonary illness and subsequent death.
- Whether the death of Dovee Yap, occurring on August 19, 2007, could be considered as occurring during the term of his employment contract or as a direct consequence of injuries sustained while on duty.
- Whether the evidence presented by the petitioner is sufficient to establish work-causation and causally link the accidental injury to the fatal illnesses (lung cancer and pneumonia).
- Whether the provisions in Dovee Yap’s Collective Bargaining Agreement (particularly Articles 22, 23, and 26.3) and the POEA Standard Employment Contract can still apply in awarding death benefits given the termination of his employment prior to his death.
