Facts:
Office of the Court Administrator v. Atty. Robert Ryan H. Esmenda, A.M. No. P-15-3299 (Formerly A.M. No. P-14-12-404-RTC), April 25, 2023, Supreme Court En Banc, Per Curiam. The Office of the Court Administrator’s (OCA) Financial Audit Team (FAT) conducted an audit covering December 1, 2005–August 30, 2010 and January 11, 2011–April 30, 2014 pursuant to Travel Order No. 47-2014 and Travel Authority dated April 3, 2014. The FAT’s Memorandum-Report (November 12, 2014) disclosed cash shortages in various judiciary funds under the custody of Atty. Robert Ryan H. Esmenda, then Clerk of Court VI, Regional Trial Court (RTC), Lipa City, totaling PHP 2,914,996.52. The OCA adopted the report and submitted it to the Court.The Court’s First Division docketed the FAT memorandum as a regular administrative complaint against Atty. Esmenda, placed him under preventive suspension, and directed him to explain the shortages and to restitute the amounts within ten days; it also ordered administrative steps for the incumbent officer-in-charge and monitoring by the Executive Judge. Atty. Esmenda submitted an Explanation/Compliance (March 27, 2015) admitting shortages but attributing them to the long absence of a Cash Clerk/Clerk III, overlooked validated deposit slips, and certain sheriff’s expenses paid directly to sheriffs or process servers; he pleaded for mercy and proposed applying his monthly RATA to the shortages.
The First Division referred the matter to the OCA for evaluation. The OCA recommended denial of Esmenda’s RATA request and secured a Hold Departure Order. After the Judicial Integrity Board (JIB) was created, the OCA referred the case to the JIB.
