Purpose and policy basis
- The Executive Order declares that the Port of San Jose in San Jose, Occidental Mindoro is one of the major and busiest ports in the country.
- The Executive Order directs the development of a new San Jose Port (Caminawit) due to the siltation problem in the old port.
- The Executive Order establishes the need to accommodate big vessels and to meet projected port traffic.
- The Executive Order links the new port’s development to the programming of necessary port facilities to support the demands of the shipping trade within the region.
Delineation of San Jose (Caminawit) port zone
- Section 1 delineates the territorial jurisdiction of the Port of San Jose (Caminawit) situated in the Municipality of San Jose, Province of Occidental Mindoro.
- The port zone is delineated by a coordinate-and-bearing boundary that begins at a point marked 1 on the plan, described as S. 23 deg. 12' E., 2,031.65 m. from BBM No. 6, Barangay Caminawit, San Jose.
- The boundary proceeds sequentially through points 2 to 11 using the bearings and distances stated in Section 1.
- The delineation provides that the port zone ends at the point of beginning, with the stated area of ONE MILLION FIFTY-ONE THOUSAND THREE HUNDRED SIXTY-EIGHT SQUARE METERS AND EIGHTY-SEVEN SQUARE DECIMETERS (1,051,368.87), more or less (Section 1).
Placement under PPA administrative jurisdiction
- Section 2 places the San Jose (Caminawit) Port Zone, as delineated, under the administrative jurisdiction of the Philippine Ports Authority (PPA).
- The PPA must implement a program for the proper zoning, planning, development and utilization of the port (Section 2).
- The PPA’s program must be implemented consistent with the regional industrial plans of the government (Section 2).
Repeal and amendment of inconsistent issuances
- Section 3 repeals, amends, or modifies all issuances, orders, rules, and regulations (or parts thereof) that are inconsistent with Executive Order No. 95.
- The repealing power is limited to inconsistencies with the Executive Order (Section 3).
Separability of invalid provisions
- Section 4 provides that if any provision of Executive Order No. 95 is declared invalid or unconstitutional, the remaining provisions not affected remain valid and subsisting.
- The separability rule ensures the Executive Order continues in operation for unaffected provisions (Section 4).
Publication and immediate effect
- Section 5 provides that Executive Order No. 95 takes effect immediately upon publication in a newspaper of general circulation.
