Purpose: Streamline and Prevent Confusion
- The circular is issued to streamline procedures in filing complaints/reports and requesting assistance from the POEA.
- The circular is issued to avoid confusion on which POEA office shall receive complaints/reports and requests for advice or assistance.
Where to File Complaints: Sworn Agency Complaints
- Complaints against licensed agencies/entities that are already reduced in writing and under oath (using a Sworn Statement/Affidavit Complaint) must be filed directly with the Docket and Enforcement Division, Adjudication Office.
- Such sworn, written complaints are received by the Docket and Enforcement Division within the Adjudication Office.
Where to File Illegal Recruitment Complaints
- Complaints for Illegal Recruitment must be filed with the Legal Assistance Division, Licensing and Regulation Office.
Where to File Requests for Advice or Assistance
- Requests for advice/assistance in the execution of Sworn Statements/Affidavit Complaints must be received/entertained by the Legal Assistance Division, Licensing and Regulation Office.
- Requests for advice/assistance in executing sworn statements must be handled whether the matter is against a licensed agency or entity or against a non-licensee or non-holder of authority.
Where to File Welfare Assistance Matters
- Requests for assistance in the enforcement of contractual obligations for repatriation must be filed directly with the Welfare Assistance Division, Welfare and Employment Office.
- Requests for assistance on matters not related to contractual obligations must be filed directly with the Welfare Assistance Division, Welfare and Employment Office.
- Requests concerning the welfare of a deployed overseas contract workers must be filed directly with the Welfare Assistance Division, Welfare and Employment Office.
Where to File Investigation Reports: Recruitment Violations
- Reports or requests for investigation of violation of recruitment rules and regulations must be filed with or referred to the Anti-Illegal Recruitment Branch, Licensing and Regulation Office.
- Reports or requests for investigation of illegal recruitment activities must be filed with or referred to the Anti-Illegal Recruitment Branch, Licensing and Regulation Office.
- Reports or requests for investigation of documentary irregularities relating to overseas employment must be filed with or referred to the Anti-Illegal Recruitment Branch, Licensing and Regulation Office.
- Such reports/investigation requests may emanate from sources outside the POEA or from POEA units and must be filed with or referred to the Anti-Illegal Recruitment Branch.
