Policy basis and housing intent
- The President’s Memorandum dated February 5, 2001 directs government agencies, including Government-Owned and Controlled Corporations, to identify areas or lands that may be proclaimed for socialized housing.
- The Order commits government to measures that provide security of tenure to informal settler families, particularly those occupying idle government lands.
- The Order relies on the fact that MWSS owns and/or holds legal title to a 15-meter wide aqueduct right-of-way known as Daang Tubo, running through San Mateo and Rodriguez in Rizal.
- The Order recognizes that a portion of the right-of-way has been occupied for years by more or less 3000 informal settler families.
- The Order is premised on an MWSS plan that uses only a portion of the right-of-way for aqueduct operations.
MWSS disposal authority for socialized housing
- Section 1 authorizes MWSS to dispose of certain portions of the aqueduct right-of-way covering the 9-meter section of the 15-meter wide right-of-way.
- The authorized 9-meter section runs from P. Rodriguez in Rodriguez to Ampid I in San Mateo.
- The disposal is made in favor of the bona fide family occupants located on the disposed portion.
- The authorized disposal is strictly for socialized housing purposes.
- MWSS must exclude the remaining 6-meter wide sections from disposition.
- The remaining 6-meter excluded sections continue to be reserved for MWSS right-of-way purposes to protect any proposed water supply project passing through the right-of-way from possible contamination or disruption.
- The socialized housing project development plan must be approved by MWSS before implementation.
Compensation and disposition proceeds
- Section 2 requires that, for the land disposition program for socialized housing purposes, MWSS shall be duly compensated for the real property to be disposed of or set aside.
- Compensation is provided for and in consideration of the land disposition program benefitting the bona fide family occupants.
- Compensation relates to the property being disposed of or set aside for the occupants living on the property.
HUDCC as lead implementing agency
- Section 3 designates HUDCC as the Lead Implementing Agency for implementing the Order.
- HUDCC may call on relevant agencies for support and assistance to effectively implement its functions.
- HUDCC functions include:
- Establishing the actual metes and bounds of the property in coordination with MWSS.
- Formulating and adopting implementing guidelines for proper disposition of the area.
- Identifying and qualifying beneficiaries.
- Establishing and implementing a fair lot pricing and payment scheme.
- Undertaking other necessary tasks for effective implementation.
- HUDCC must ensure participation of the duly organized beneficiaries association and other stakeholders in effectuating the disposition.
- Funding requirements for activities connected with implementation must come from HUDCC and be included in its budget.
Revocation, separability, and effectivity
- Section 5 provides that all previous issuances inconsistent with the provisions of the Executive Order are deemed revoked or amended accordingly.
- Section 6 declares the provisions separable; if any provision is declared null and void, the validity of the other provisions is not affected.
- Section 7 provides that the Executive Order takes effect immediately.
