Authority, policy, and need for action
- The issuance is anchored on the President’s authority under the Administrative Code of 1997 to reorganize the Office of the President and transfer functions among departments or agencies.
- It establishes the need to create a new task force because illegal recruitment persists as a crime of economic sabotage.
- It recognizes that a prior task force against illegal recruitment had been created pursuant to Executive Order No. 325 (s. 2004) and was automatically dissolved after one year.
- It declares the purpose of having more focused, concerted, coordinated, and effective action to stop and eliminate illegal recruitment.
Task Force creation and placement
- Section 1 creates the Task Force Against Illegal Recruitment (TFAIR).
- The TFAIR is placed under the supervision of the Commission on Filipinos Overseas for policy and program coordination.
- The TFAIR is tasked to develop and execute strategies and schemes targeting illegal recruitment operations and related criminal activities.
- The TFAIR is also responsible for ensuring prosecution of illegal recruiters, syndicates, and protectors.
Functions: strategies and prosecution focus
- The TFAIR must develop and execute strategies and schemes against the modus operandi of illegal recruiters, including escort services within international airports and other points of departure (Section 1(a)).
- The TFAIR must develop and execute strategies against syndicates responsible for tampering and sale of spurious passports and travel documents (Section 1(b)).
- The TFAIR must ensure the prosecution of illegal recruiters, syndicates, and protectors (Section 1(c)).
Composition and principal office
- The TFAIR is composed of the Chairman of the Commission on Filipinos Overseas as Chair (Section 2).
- The TFAIR must include a sufficient number of members, as determined by the Chairman.
- The members must come from the staff of the National Bureau of Investigation, the Philippine National Police, and other relevant government agencies, detailed by their respective heads (Section 2).
- The Manila International Airport Authority must provide sufficient space at the Ninoy Aquino International Airport (NAIA) to serve as the TFAIR’s principal office (Section 3).
Powers: surveillance, investigation, coordination
- The TFAIR must conduct surveillance and entrapment operations of persons alleged to be engaged in illegal recruitment, including escort services at international airports and other points of departure (Section 4(a)).
- The TFAIR must cause or direct the immediate investigation and speedy prosecution of cases involving illegal recruitment and monitor case progress (Section 4(b)).
- The TFAIR must coordinate with existing bodies, agencies, and other instrumentalities involved in the campaign against illegal recruitment (Section 4(c)).
- The TFAIR must perform other powers and functions necessary for effective discharge of its functions or as directed by the President (Section 4(d)).
Assistance, cooperation, and coordination obligations
- Section 5 directs the Department of Foreign Affairs, Manila International Airport Authority, National Bureau of Investigation, the Office of the Chief State Prosecutor of the Department of Justice, Philippine National Police, Philippine Overseas Employment Administration, Bureau of Immigration, and all other government agencies to actively support the anti-illegal recruitment campaign.
- Section 5 requires these agencies to coordinate and cooperate with the TFAIR.
- The Chairman of the TFAIR may call upon the heads of government agencies for assistance as necessary, from time to time (Section 5).
Funding source
- Funding for the TFAIR’s operation must come from available funds identified by the Department of Budget and Management (Section 6).
Repeal and continuing coverage
- Section 7 repeals, amends, or modifies all orders, rules, regulations, issuances, or parts thereof that are inconsistent with Executive Order No. 548.
- The TFAIR remains effective for one year from its immediate effectivity, and the executive framework continues within that period under Section 8.
