It promulgates the Rules and Regulations implementing Republic Act No. 8534 (Philippine Interior Design Act of 1998), pursuant to Section 10, Article III of RA 8534, to effectively carry out the provisions of the Act.
Interior Design is the functional, orderly and aesthetic arrangement and development of building and residential interiors that enhances and safeguards life, health and property and promotes/enriches the quality of life.
It includes planning, designing, specifying, supervising, and giving general administration/responsible direction over interiors, including consultation and evaluation; schematic designs and contract documents; feasibility studies; plans/specifications/bill of materials/cost estimates; and interior construction/project management (administration, supervision, coordination and direction), including renovation/demolition/alteration/preservation/restoration of building interiors; and teaching interior design subjects and computer-aided design.
It has a Chairman and two (2) Members—three (3) board members in total.
The President appoints them from lists of three (3) recommendees for each vacant position submitted by the PRC, selected from lists of five (5) nominees per vacancy nominated by the duly accredited and integrated association of Interior Designers in the Philippines.
They must be: (1) Filipino citizen and resident; (2) at least 35 years old with proven integrity; (3) holders of a BS Interior Design (PH or abroad recognized/accredited by PH government); (4) registered Interior Designers with valid license and active practice for at least 10 years; (5) not faculty teaching regular Interior Design courses and have no pecuniary interest or administrative supervision over such schools; (6) not connected with review centers/groups giving licensure review classes/lectures; (7) members in good standing of the accredited and integrated association; and (8) never convicted of any offense involving moral turpitude.
The term is three (3) years and they serve until their successors are appointed and qualified; they may be re-appointed for a second term, and each takes an oath prior to assumption of duty.
It is filled for the unexpired portion of the term only.
The Board acts en banc, deliberates, and votes personally. Quorum is two (2) members, and a majority vote is required; since quorum is two (2), the vote of two (2) members constitutes the majority vote. Also, actions by the Board other than dispositive decisions/orders in admin cases require approval by the Commission.
No. Resolutions/issuances whose purpose is to enforce/implement RA 8534 or regulate the public must be published in the Official Gazette or in a newspaper of general circulation; and actions by the Board en banc other than dispositive decisions/orders in admin cases are valid/enforceable only after approval by the Commission.
They must pass the licensure examination for interior design unless expressly exempted by RA 8534.
A weighted general average of at least 75%, with no subject grade lower than 60%.
They must take a removal examination only in the subject(s) where they scored below 60%, within two (2) years from the date of the last examination. If they fail the removal exam, they must thereafter take the examination in all subjects. The removal exam is taken only once within the two-year period and is considered as one examination for purposes of re-examination.
If the examinee fails to pass the examination for the third time, they may take another examination only after the lapse of one (1) year from the last examination taken, which will be the third failure.
The Board, after consultations with the academe, formulates and adopts a syllabus/term of specifications per subject, and amends it to reflect curriculum changes only when examinees have already taken those changes in school. Test questions must be within the scope of the adopted syllabus.
The examination is fully computerized. New Board members assigned to a subject must prepare at least 500 test questions to encode in the test bank from which questions are randomly extracted. The bank is replenished within 60 days from release of results with at least 300 questions after each exam until it reaches 2,000 total; thereafter replenishment equals the number extracted.
They are automatically registered as Interior Designers under RA 8534 without need of filing for registration, provided they pay the registration fee for issuance of certificates. Those registered but not practicing or delinquent at effectivity must register by filing an application; there is no deadline for such filing.
They include: (1) final conviction of a crime involving moral turpitude; (2) immoral/dishonorable conduct; (3) judicial declaration of unsound mind; (4) fraud/deceit in obtaining registration; (5) gross negligence; (6) unprofessional/unethical/dishonorable conduct; (7) chronic inebriety; (8) habitual use of drugs; (9) abatement of illegal practice; and (10) violation of RA 8534, its rules, or the Code of Ethics.
It prohibits stamping/sealing with an expired/lost seal unless reinstated/renewed; it bars government/city/provincial/municipal enforcement officials from accepting/endorsing or approving payment for interior plans/specifications not prepared and submitted in full compliance with RA 8534, signed/sealed by a duly licensed Interior Designer.
Aside from administrative sanctions, upon conviction, the violator may be fined not less than Php 50,000 nor more than Php 200,000 or imprisoned not less than three (3) months, or both, at the direction of the court.
