Executive Order No. 150 authorizes the MWSS to dispose certain portions of its abandoned aqueduct right-of-way (Daang Tubo) in favor of bona fide family-occupants for socialized housing purposes.
MWSS is authorized to dispose of the 9-meter section of the 15-meter wide right-of-way, from P. Rodriguez in Rodriguez to Ampid I in San Mateo.
The remaining 6-meter wide sections must be excluded and reserved for MWSS right-of-way purposes to protect any proposed water supply project from contamination or disruption.
The proposed development plan for the socialized housing project must be approved by MWSS.
The HUDCC (Housing and Urban Development Coordinating Council) is designated as the lead implementing agency.
HUDCC must (1) establish actual metes and bounds with MWSS; (2) formulate implementing guidelines; (3) identify and qualify beneficiaries; (4) establish and implement fair lot pricing and payment scheme; and (5) perform other necessary tasks. It must ensure participation of duly organized beneficiaries associations and stakeholders.
MWSS must be compensated for the real property to be disposed of or set aside for the benefit of bona fide family occupants, and the proceeds are to be remitted to MWSS.
While the EO does not define the term in the text provided, it requires HUDCC to identify and qualify beneficiaries, and to formulate implementing guidelines that would determine who qualifies as bona fide occupants.
A Memorandum of the President dated February 5, 2001 directing all heads of government departments, agencies, and instrumentalities (including GOCCs) to identify lands that may be proclaimed for socialized housing.
It states the government’s commitment to provide security of tenure to informal settler families, particularly those occupying idle government lands no longer suitable or utilized for their intended purpose.
The EO notes that a portion of the aqueduct right-of-way has been occupied for several years by approximately 3,000 informal settler families, and that MWSS’s plan requires utilization of only part of the right-of-way.
All previous issuances inconsistent with EO No. 150 are deemed revoked or amended accordingly.
It provides that if any provision is declared null and void, the invalidity of that provision does not affect the validity of the remaining provisions.
It takes effect immediately upon issuance.
HUDCC must ensure participation of duly organized beneficiaries associations and other stakeholders during the disposition and implementation.
The funding requirements for various activities must come from HUDCC and be included in its budget.
