Executive Order No. 548 was issued by the President pursuant to the powers vested in her by law and in line with the Administrative Code of 1997 (continuing authority to reorganize the Office of the President and transfer functions), and it references the prior anti-illegal recruitment task force created under Executive Order No. 325 (s. 2004).
TFAIR is placed under the supervision of the Commission on Filipinos Overseas for policy and program coordination.
First, the earlier Presidential Anti-Illegal Recruitment Task Force created under Executive Order No. 325 was automatically dissolved after one year. Second, reports indicate that illegal recruitment remains unabated, warranting a more focused, coordinated, and effective program of action.
TFAIR must: (a) develop and execute strategies against the modus operandi of illegal recruiters (e.g., escort services within international airports and other points of departure); (b) develop and execute strategies against syndicates involved in tampering and sale of spurious passports and travel documents; and (c) ensure the prosecution of illegal recruiters, syndicates, and protectors.
The Chairman of the Commission on Filipinos Overseas serves as Chair. The number of members is determined by the Chairman, and members are drawn from the staff of the NBI, PNP, and other relevant agencies, detailed by their respective heads.
The Manila International Airport Authority must provide sufficient space at the Ninoy Aquino International Airport (NAIA) to serve as the principal office of TFAIR.
TFAIR may: (a) conduct surveillance and entrapment operations on persons alleged to be engaged in illegal recruitment (including escort services); (b) cause or direct immediate investigation and speedy prosecution of illegal recruitment cases and monitor case progress; (c) coordinate with existing bodies and agencies involved in anti-illegal recruitment; and (d) perform other necessary functions as directed by the President.
Executive Order No. 548 expressly authorizes TFAIR to conduct surveillance and entrapment operations against persons alleged to engage in illegal recruitment, including those offering escort services at airports and other departure points.
The Department of Foreign Affairs, Manila International Airport Authority, NBI, Office of the Chief State Prosecutor (Department of Justice), PNP, Philippine Overseas Employment Administration, Bureau of Immigration, and all other government agencies are directed to actively support and coordinate with TFAIR.
The Chairman of TFAIR may call upon the heads of government agencies for assistance whenever necessary, as may be required from time to time.
Funds for TFAIR operations are sourced from available funds identified by the Department of Budget and Management.
It takes effect immediately and remains in full force for a period of one year.
It repeals, amends, or modifies all orders, rules, regulations, and issuances—or parts thereof—that are inconsistent with Executive Order No. 548.
The Executive Order targets illegal recruitment, including recruiter modus operandi at airports (e.g., escort services), as well as syndicates involved in tampering and sale of spurious passports and travel documents, and their protectors—linked to illegal recruitment and economic sabotage.
TFAIR is tasked to ensure prosecution of illegal recruiters, syndicates, and protectors, and it has authority to cause or direct immediate investigation and speedy prosecution of cases while monitoring progress of those cases.
It mainly creates an enforcement/coordination body (TFAIR) and defines its functions and powers (surveillance, entrapment, investigation coordination, and monitoring/prosecution support). The EO does not define or create a new criminal offense; it focuses on organization and enforcement against illegal recruitment.
