On January 23, 2003 an Information charged Rebucan with double murder for the November 6, 2002 killings of Felipe Lagera (65) and infant Ranil/Ramil Tagpis, Jr. The Information alleged deliberate intent, treachery, evident premeditation and abuse of superior strength, and described fatal hacking wounds inflicted with a long bolo. Rebucan pleaded not guilty at arraignment on February 10, 2003 and trial ensued in the Regional Trial Court (RTC), Branch 13, Carigara, Leyte, in Criminal Case No. 4232.
The prosecution presented medical testimony (Dr. Ma. Bella V. Profetana) establishing fatal hacking wounds and causes of death, eyewitness testimony by five‑year‑old Carmela Tagpis who identified Rebucan as “Bata Endong” and described a sudden unprovoked attack, and testimony from relatives corroborating Carmela’s identification. Documentary exhibits included post‑mortem reports, anatomical sketches of wounds and death certificates. The defense produced witnesses (including the accused’s stepson Raymond Rance and the barangay chairperson Renerio Arminal), the police blotter entry recording Rebucan’s voluntary surrender, and Rebucan’s own testimony claiming provocation (his wife’s alleged sexual molestation by Felipe and/or his son), partial intoxication, and that the death of the child was accidental.
On November 3, 2003 the RTC convicted Rebucan of double murder, found several aggravating circumstances (treachery, evident premeditation, dwelling, intoxication, abuse of superior strength, minority of the child victim) but credited mitigating circumstances of admission and voluntary surrender, and sentenced him to death with awards of P75,000 civil indemnity and P75,000 moral damages for each victim. The case was originally elevated to the Supreme Court on automatic review (docketed G.R. No. 161706), but by Resolution dated July 19, 2005 the Court ordered transfer to the Court of Appeals (CA) pursuant to People v. Mateo.
The Court of Appeals, in CA‑G.R. CR.‑H.C. No. 00282, promulgated a decision on August 21, 2007 modifying the RTC judgment: it held Rebucan guilty of two separate counts of murder (not a complex crime of double murder), credited only voluntary surrender as mitigating circumstance, set the penalty at reclusion perpetua for each count, reduced civil indemnity and moral damages to P50,000 each per victim, and awarded exemplary damages of P25,000 per victim. Rebucan filed a Notice of Appeal; the CA forwarded the records to the Supreme Court and this Court resolved to accept the appeal on June 18, 2008.
